Terms and Conditions


  

Acceptance of Terms by hiring or engaging Danny Ivan Media LLC and Media Haste ("we," "us," "our," "Service Provider") for services, you ("Client") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.


Upon booking, you agree to the following terms and conditions listed below.

Service Providers include, but not limited to, photographer, videographer, drone operator, or any associates with Danny Ivan Media LLC and Media Haste. We reserve the right to modify these Terms and Conditions at any time. The updated version will be made available on this webpage and will take effect immediately.


For Real Estate and Commercial Real Estate purposes


1. Scope of Services

The Service Provider agrees to provide photography, videography, drone, and related media services as outlined in the selected service, package or written agreement.

All services are performed in accordance with industry standards and at the Service Provider’s professional discretion. Specific image counts, compositions, and angles are not guaranteed unless agreed upon in writing.

Additional services requested beyond the original agreement may be subject to additional fees.


2. Booking and Payment

A 100% non-refundable deposit (retainer) is required to secure all bookings.

Payment must be made using approved methods listed on dannyivanmedia.com, mediahaste.com, HD Photo Hub, Venmo, or in the payment invoice.

Additional On-Site Services: If available, the client may request additional services not originally requested (e.g., drone photography, 3D Zillow Tours, etc.). Client will receive a separate invoice for the additional charge. 

No media services will be conducted/delivered until full payment, including any additional charges, has been received.

Granting of the usage license is strictly conditioned upon the Service Provider receiving full payment. Any use of the media prior to full payment constitutes a breach of this agreement and an infringement of copyright.

While the Service Provider monitors conditions, the Client is responsible for reviewing the weather forecast prior to booking and throughout the lead-up to the appointment to ensure the property will be presented as desired. 


3. Cancellation and Rescheduling

Cancelled or incomplete sessions are non-refundable. Rescheduling is subject to availability and may incur additional fees.

  • Client-Initiated Changes: Clients      must notify the Service Provider of any cancellation or rescheduling      request at least four (4) hours prior to the Service Provider’s scheduled      departure. Failure to provide timely notice (within the 4-hour window)      will result in the forfeiture of all payments for that session to cover      allocated time and travel expenses.
  • Courtesy Rescheduling & Limits:      As a courtesy, the Service Provider allows up to three (3) reschedules per      session without penalty, provided they are requested at least four (4)      hours in advance.
    • Rescheduling Fees: Starting with       the fourth (4th) reschedule request, a separate invoice for non-refundable       $50 Rescheduling Fee will be delivered. This fee must be paid before the       new session time is confirmed.
  • Service Provider Discretion: The      Service Provider reserves the exclusive right to cancel or reschedule      services due to emergencies, unsafe conditions, legal restrictions, or      weather that may endanger equipment or personnel (e.g., high winds for      drone operations or heavy rain). The Service Provider’s assessment of      safety and equipment limitations is final.
  • Communications: Reminder or      confirmation messages may be provided as a courtesy but are not      guaranteed. The absence of such communication does not waive cancellation      or rescheduling policies.


4. Client Responsibilities

Property Condition: All properties are photographed "as-is." The Service Provider does not provide cleaning, staging, or moving of furniture/personal items.

Preparation: The property must be 100% photo-ready by the scheduled start time.

Minor Adjustments & Liability: At the Service Provider’s sole discretion, minor aesthetic adjustments (e.g., straightening a pillow, moving a single small countertop item) may be performed to improve shot composition. If the Client is not present, the Service Provider is authorized to make these minor adjustments. This includes, but is not limited to, turning on interior lights, turning off ceiling fans, and adjusting window blinds/slat angles. The Service Provider is not liable for any damage to property, fixtures, or personal items resulting from these "courtesy" movements.

The Service Provider is not responsible for the state of the property upon departure, including but not limited to, the status of utilities, lights, fans, or the locking of doors/windows.

Furniture & Large Items: For liability and safety reasons, the Service Provider does not move furniture, appliances, or large amounts of clutter. If the Client specifically requests assistance with moving such items, the Client acknowledges and agrees to the following:

  • Assumption of Risk: The Client      assumes all risk of damage to the property, floors, or the items      themselves. The Service Provider shall be held harmless for any damage      occurring during such assistance.
  • Delay Fees: Upon Service Provider      discretion, any time spent moving furniture or large-scale clutter will be      billed at the standard Delay Fee rate ($25 per 15-minute increment),      regardless of whether the Service Provider is assisting or waiting for the      Client to finish.
  • Right of Refusal: The Service      Provider reserves the right to refuse to move any item deemed too heavy,      fragile, or hazardous.

Safety & Hazards: The Client must ensure the property is safe, pets are secured, and valuables are removed. Failure to prepare the property may result in an incomplete session or a "Full-Price" cancellation at the Service Provider’s discretion.


5. Delays and Additional Charges

Scheduled Time Slots: Each service is assigned an estimated duration. The "Scheduled Session" is the total sum of these durations. The session clock begins at the scheduled start time.

Delay Fee: A 15-minute grace period is provided for delays outside the Service Provider’s control. After 15 minutes, a delay fee of $25 per 15-minute increment (or portion thereof) will be applied for any time spent waiting for property access, property preparation, or client delays.

Access & Communication Cut-off: 

30-Minute No-Response Rule: If the Service Provider cannot gain access upon arrival and the Client fails to respond to communication (phone/text/email) within 30 minutes, the session will be deemed a "No-Show" and cancelled without refund.

Incomplete Work & Delivery: If a session begins late due to Client-side delays, the Service Provider will capture as much as possible within the remaining original time slot.

  • The "Stay-Late" Option:      If the Service Provider’s schedule allows, the Client may request to      extend the session to complete all services.
  • Grace Period & Billing: A      15-minute grace period is provided. If the session exceeds the original      end time by more than 15 minutes, a Delay Fee ($25 per 15-minute      increment) will be applied to the final invoice, calculated from the      original scheduled end time.
  • No Guarantee of Completion: If the      Service Provider’s schedule does not allow for an extension, they do not      guarantee the completion of the full-service package. No refunds or      credits will be issued for media missed due to Client delays.

Payment of Fees: All additional fees (Delay Fees or Rescheduling Fees) must be settled before final media is released.

Service Provider Delays: If the Service Provider is delayed (e.g., due to traffic or equipment issues), the Client will be notified as soon as possible. In this event, the "Scheduled Session" window will be shifted to ensure the Client receives their full allotted media capture time at no additional cost. If the Service Provider is more than one (1) hour late, the Client may choose to either proceed with the shifted schedule or reschedule the session at no cost.


6. Refusal or Termination of Services

The Service Provider reserves the right to refuse or terminate services if:

  • Unsafe conditions exist
  • Legal concerns arise
  • The Client or associated parties      engage in disruptive, disrespectful, or inappropriate behavior
  • A hostile or hazardous environment is present

In such cases, no refund will be issued.


7. Recording of Interactions

The Service Provider reserves the right to photograph and record media (audio and/or video) the interactions, communications, and on-site encounters with Clients or associated parties for quality assurance, safety, and documentation purposes.

The capturing of these photographs/media may be used as marketing material for Danny Ivan Media LLC/Media Haste or evidence in the event of legal disputes, claims, or other proceedings.

By engaging the Service Provider’s services, the Client consents to such photographs and recordings of media, where permitted by applicable law.


8. Delivery and Turnaround

Media will be delivered through an online gallery through HD Photo Hub used by mediahaste.com/dannyivanmedia.com or another agreed-upon method.

The Service Provider strives to deliver media promptly, with typical turnaround times of approximately 24 hours for photography, 48 hours for walkthrough video services and 72 hours for cinematic video services. While these timeframes are standard targets, delivery times may vary due to project scope, volume, or unforeseen circumstances.

The Service Provider will make reasonable efforts to communicate any delays and provide updated delivery expectations when necessary.

9. Cloud Storage Policy

Delivered media will be stored for thirty (30) days from the delivery date.

If additional services are purchased within this period, storage may be extended.

After expiration, files may be permanently deleted. The Service Provider is not responsible for archived or deleted files.

Clients are encouraged to download and back up all media promptly.


10. Copyright and Usage Rights

All images, videos, and media remain the intellectual property of Danny Ivan Media LLC and Media Haste.

The Client is granted a non-exclusive, non-transferable license to use the media for personal and commercial marketing related to the subject property for real estate.

Media may not be resold, sublicensed, altered (such as re-edited or use of AI), or redistributed for public media and/or monetary gain without written permission.


11. Editing and Retouching

Real Estate Services:

Professional color correction and standard retouching are included. Additional editing requests may incur extra fees.

Drone Services:

Professional editing is limited to color-correction and very minor object removing unless stated in writing. Additional editing may be billed separately.


12. Model Release and Marketing Use

Unless otherwise agreed in writing, the Client grants permission to Danny Ivan Media LLC the use of images and media for portfolio, advertising, website, and promotional purposes.


13. Floor Plans (If Applicable)

Floor plans are for marketing and illustrative purposes only.

Measurements are approximate and not intended for legal, appraisal, or valuation use.

Clients and buyers are responsible for independent verification.


14. Photo-to-Video

Our Photo-to-Video service utilizes advanced Artificial Intelligence (AI) to animate still imagery. Clients acknowledge and agree to the following:

  • Interpretive Motion: The AI      generates motion by predicting and "filling in" visual data.      This process is interpretive and may occasionally result in minor visual      artifacts, warped lines, or the softening of architectural details.
  • Representation Disclaimer: While we      strive for high-quality output, these videos are intended for artistic and      marketing purposes only. They may not be a 100% technically accurate      representation of the property's physical state.
  • Accuracy Acknowledgment: We are not      liable for any discrepancies between the AI-animated video and the      physical property that may lead to claims of "misrepresentation"      in a real estate context.
  • No Structural Reliance: Prospective      buyers should not rely on Photo-to-Video content for structural or      material assessments; standard still photography and on-site walkthroughs      remain the primary records of the property's condition.


15. Virtual Photos & Post-Production Enhancements

While we strive for realism, Virtual Photos is a digital representation of a property’s potential. Clients are responsible for ensuring that virtually staged images comply with local MLS rules regarding "truth in advertising." We do not digitally remove permanent structural defects.


16. Physical Installations

A. Site Marking and Instructions

The Client is solely responsible for providing precise instructions or physical markers (e.g., utility flags or stakes) indicating where the sign post should be installed.

  • Placement Compliance: The Client      must ensure the requested location complies with all local Homeowners      Association (HOA) bylaws, city ordinances, and property line restrictions.
  • Relocation Fees: If a post must be      moved after installation due to incorrect instructions or HOA violations,      a Relocation Fee of $150 will be applied.

B. Invasive Installation & Utility Risk

The Client acknowledges that installation requires the use of a heavy-duty stake driven invasively into the ground to puncture the turf and soil.

  • Private Utility Lines: We are not      responsible for damage to any underground private lines, including but not      limited to:
    • Irrigation/sprinkler systems and       heads.
    • Landscape lighting and low-voltage       wiring.
    • Invisible dog fences or private drainage       pipes.
  • Public Utilities: While we may      contact local "Call Before You Dig" services where required by      law, these services only mark public utility lines (gas, electric, water      mains). They do not mark private lines located on the property.

C. Assumption of Risk

· By ordering a Sign Post Installation, the Client assumes all risk associated with the puncture of the ground. Danny Ivan Media LLC, Media Haste and any associates shall be held harmless for any property damage resulting from the installation or removal of the post, provided the installer placed the post in the area designated by the Client.


17. Drone Services – Additional Terms

Drone services are subject to:

  • FAA and local aviation regulations
  • Weather conditions
  • Airspace restrictions
  • Line-of-sight and safety      limitations

The Service Provider reserves the right to cancel or modify drone operations when required for safety or legal compliance.

The Client must obtain all required permissions for drone operations over private property or events.


18. Reshoots and Quality Assurance

All media services provided by Danny Ivan Media LLC / Media Haste are considered final upon delivery. We pride ourselves on professional-grade quality; however, we recognize that objective errors can occur.

  • Finality of Sale: Except as      expressly stated below, all sales are final, and no refunds or      complimentary reshoots will be issued for subjective preferences (e.g.,      "I don't like the furniture placement" or "I wish the sky      was a different shade of blue").
  • Gross Misrepresentation &      Workmanship: If the Client believes the delivered media contains gross      misrepresentations or exhibits poor workmanship (e.g., significant      technical errors, missed rooms requested in the initial brief, or      equipment failure), the Client must submit a written dispute within one      week of delivery.
  • Investigation Process: Danny Ivan      Media LLC / Media Haste will investigate the matter by reviewing the      original brief and the delivered assets. We reserve the sole right to      determine if a no-charge reshoot or correction is warranted based on our      quality standards and the original scope of work.
  • Exclusions: Reshoots will not be      provided free of charge for circumstances outside of our control,      including but not limited to:
    • Property cleanliness or staging       issues.
    • Weather conditions.
    • Specific angles or shots not requested in the original order.


19. Liability and Force Majeure

The Service Provider is not liable for delays, failures, or losses caused by circumstances beyond reasonable control, including but not limited to weather, government restrictions, technical failures, venue limitations, or acts of God.

In the event of equipment failure or data loss, liability is limited to a refund of fees paid for the affected service.

The Client agrees to indemnify and hold harmless the Service Provider from any claims arising from the use of delivered media.

In no event shall the Service Provider’s total cumulative liability for any claim, damage, or loss—whether arising in contract, tort, or otherwise—exceed the total dollar amount actually paid by the Client for the specific session giving rise to the claim.


20. Confidentiality

All client information will be kept confidential and will not be disclosed without consent, except as required by law.


21. Governing Law

These Terms & Conditions shall be governed by the laws of the State of Arizona.

Any disputes shall be resolved in the appropriate courts within Arizona.


22. Agreement

By booking services, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
