Acceptance of Terms by hiring or engaging Danny Ivan Media ("we," "us," "our," "Service Provider") for services, you ("Client") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
Upon booking, you agree to the following terms and conditions listed below.
Service Providers include, but not limited to, photographer, videographer, drone operator, or any associates with Danny Ivan Media. We reserve the right to modify these Terms and Conditions at any time. The updated version will be made available on this webpage and will take effect immediately.
For Real Estate and Commercial Real Estate purposes
1. Scope of Services
The Service Provider agrees to provide photography, videography, drone, and related media services as outlined in the selected service, package or written agreement.
All services are performed in accordance with industry standards and at the Service Provider’s professional discretion. Specific image counts, compositions, and angles are not guaranteed unless agreed upon in writing.
Additional services requested beyond the original agreement may be subject to additional fees.
2. Booking and Payment
A 100% non-refundable deposit (retainer) is required to secure all bookings.
Payment must be made using approved methods listed on dannyivanmedia.com, Venmo, or in the payment invoice.
No media will be delivered until full payment, including any additional charges, has been received.
3. Cancellation and Rescheduling
Cancelled or incomplete sessions are non-refundable.
Rescheduling is subject to availability and may incur additional fees.
Clients must notify the Service Provider of any cancellation or rescheduling request prior to the Service Provider’s departure to the scheduled location.
Failure to provide timely notice will result in forfeiture of all payments to cover time and travel expenses.
Reminder or confirmation messages may be provided as a courtesy but are not guaranteed. The absence of such communication does not waive cancellation or rescheduling policies.
The Service Provider reserves the right to cancel or reschedule services due to emergencies, unsafe conditions, weather, legal restrictions, or circumstances beyond reasonable control.
4. Client Responsibilities
The Client is responsible for ensuring that the property or location is safe, accessible, and prepared at the scheduled time.
All photo and video services will be captured in the property’s current condition (“as is”).
The Client is responsible for cleaning, staging, securing valuables, and removing hazards prior to the session.
The Client must obtain all required permissions, authorizations, and notices for any persons, properties, or locations involved.
Failure to provide access or proper preparation may result in a cancelled or incomplete session without refund.
5. Delays, Scope Changes, and Additional Charges
If the scope of services changes due to inaccurate or incomplete information, additional service requests, or unforeseen requirements, the Service Provider may issue a supplemental invoice (“rebill”).
Delays caused by the Client, including waiting time due to unprepared properties, restricted access, or late arrival, may result in additional charges of $25 per 30-minute delay.
All additional fees must be paid prior to final media delivery and will be calculated at current standard rates.
6. Refusal or Termination of Services
The Service Provider reserves the right to refuse or terminate services if:

7. Recording of Interactions
The Service Provider reserves the right to audio and/or video record interactions, communications, and on-site encounters with Clients or associated parties for quality assurance, safety, and documentation purposes.
Such recordings may be used as evidence in the event of legal disputes, claims, or other proceedings.
By engaging the Service Provider’s services, the Client consents to such recordings, where permitted by applicable law.
8. Image Delivery and Turnaround
Media will be delivered through an online gallery at dannyivanmedia.com or other agreed method.
Standard turnaround time is approximately 24 hours for most services. Delays may occur due to unforeseen circumstances.
The Service Provider will make reasonable efforts to communicate any delays.
9. Cloud Storage Policy
Delivered media will be stored for thirty (30) days from the delivery date.
If additional services are purchased within this period, storage may be extended.
After expiration, files may be permanently deleted. The Service Provider is not responsible for archived or deleted files.
Clients are encouraged to download and back up all media promptly.
10. Copyright and Usage Rights
All images, videos, and media remain the intellectual property of Danny Ivan Media.
The Client is granted a non-exclusive, non-transferable license to use the media for personal and commercial marketing related to the subject property.
Media may not be resold, sublicensed, altered (such as re-edited or use of AI), or redistributed for public media and/or monetary gain without written permission.
11. Editing and Retouching
Real Estate Services
Professional color correction and standard retouching are included. Additional editing requests may incur extra fees.
Drone Services
Professional editing is limited to color-correction and object removing unless stated in writing. Additional editing may be billed separately.
12. Model Release and Marketing Use
Unless otherwise agreed in writing, the Client grants permission to Danny Ivan Media the use of images and media for portfolio, advertising, website, and promotional purposes.
13. Floor Plans (If Applicable)
Floor plans are for marketing and illustrative purposes only.
Measurements are approximate and not intended for legal, appraisal, or valuation use.
Clients and buyers are responsible for independent verification.
14. Drone Services – Additional Terms
Drone services are subject to:
The Service Provider reserves the right to cancel or modify drone operations when required for safety or legal compliance.
The Client must obtain all required permissions for drone operations over private property or events.
15. Liability and Force Majeure
The Service Provider is not liable for delays, failures, or losses caused by circumstances beyond reasonable control, including but not limited to weather, government restrictions, technical failures, venue limitations, or acts of God.
In the event of equipment failure or data loss, liability is limited to a refund of fees paid for the affected service.
The Client agrees to indemnify and hold harmless the Service Provider from any claims arising from the use of delivered media.
16. Confidentiality
All client information will be kept confidential and will not be disclosed without consent, except as required by law.
17. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Arizona.
Any disputes shall be resolved in the appropriate courts within Arizona.
18. Agreement
By booking services, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
For Portrait Purposes
1. Booking and Payment
A 25% non-refundable deposit is required to secure your booking. The remaining balance must be paid two (2) days before the scheduled session date. Payment can be made via accepted payment methods by the Danny Ivan Media. Sessions are scheduled on a first-come, first-served basis. A session is only confirmed upon receipt of the deposit.
2. Cancellation and Rescheduling
Cancellations must be made at least 24-hours in advance to be eligible for rescheduling without loss to your non-refundable deposit. Failure to cancel before 24-hour notice will result in complete loss of your non-refundable deposit and a new non-refundable deposit will be required for future bookings. In the event of unforeseen circumstances (e.g., illness, weather conditions), the session may be rescheduled at a mutually agreed-upon date. The Service Provider reserves the right to cancel or reschedule a session due to emergencies or circumstances beyond their control. In such cases, the deposit may be refunded.
3. Session Details
The client is responsible for arriving on time. Any delay may result in a shorter session duration. Outfits, props, and location choices should be discussed in advance to ensure a smooth session. Additional time or location changes may incur extra fees.
4. Refuse or Terminate Services
The Service Provider reserves the right to refuse or terminate services at any time if the Service Provider believes or feels a client (or individuals associated with the client) exhibits, but not limited to, unruly, disrespectful, or inappropriate behavior. Professional conduct is expected from all parties, and any actions that create an unsafe, disruptive, or hostile environment may result in the immediate cancellation of services without a refund. In short, treat the Service Provider(s) the same way you want to be treated with dignity and respect.
5. Image Delivery and Usage
Edited digital images will be delivered up to a four-week timeframe via through dannyivanmedia.com. Raw or unedited images will not be provided. The client receives a limited, non-commercial license for personal use of the images. The Service Provider retains full copyright and may use the images for portfolio, marketing, and promotional purposes unless the client requests in writing to keep them private. If client wishes to use their photographs for commercial use, please draft a licensing agreement to negotiate with the Service Provider.
6. Retouching and Editing
Basic retouching (color correction, blemish removal, etc.) is included in the service. Additional retouching requests or laborious editing may be subject to additional fees.
7. Liability
The Service Provider is not responsible for any personal injury, property damage, or other incidents that occur during the session. In the unlikely event of data loss or equipment failure, the Service Provider's liability is limited to a full refund of the session fee.
8. Model Release
By booking a session, the client grants the Service Provider permission to use images for portfolio and marketing purposes unless otherwise agreed in writing.
9. Agreement
By booking a portrait session, the client agrees to these terms and conditions. For any questions or concerns, please contact your Service Provider.
