Terms and Conditions

Terms and Conditions


Upon booking, you agree to the following terms and conditions listed below.

Service Providers include, but not limited to, photographer, videographer, drone operator, or any associates with Danny Ivan Media. We reserve the right to modify these Terms and Conditions at any time. The updated version will be made available on this webpage and will take effect immediately.


Acceptance of Terms By hiring or engaging Danny Ivan Media ("we," "us," "our") for services, you ("Client") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.


For Real Estate and Commercial Real Estate purposes:


1. Scope of Services: 

The Service Provider agrees to provide photography services as outlined in the agreed-upon package or contract. Any additional services requested may be subject to additional fees. The Service Provider is subject to provide photo images based on market standards without given direction and subject to the Service Provider's discretion. Example: Real Estate photos, by default of the Service Provider may provide images of the Master Bedroom (3), Master Bedroom Bathroom (2), Master Bedroom Closet (1), Kitchen (3), Family/Living Room (2), Dining Area (2), Second Bedroom (1), Third Bedroom (1), Second Bathroom (1), Foyer (1), Linen Closet (1), Coat Closet (1), Washer and Dryer Area (1), and Pantry (1). Feel free to communicate with the Service Provider on additional details based on your needs or of your clients.

2. Booking and Payment: 

100% non-refundable deposit is needed to secure your booking session (also known as "retainer"). Payments should be made using the accepted methods detailed in the website or payment email. Photos from your session will be available at dannyivanmedia.com or other means requested. 

3. Cancellation and Rescheduling: 

Cancelled/incomplete session are not refundable. Rescheduling is subject to availability and may incur an additional fee depending on circumstances. The Service Provider reserves the right to cancel services. If the Client needs to reschedule a photography session, they must notify the Photographer prior to the Photographer's departure for the scheduled location. Failure to provide timely notice will result in a cancelled or incomplete session and a refund will not be issued. The non-refund is intended to cover time and travel expenses incurred if notice is not received before departure. Clear and prompt communication is essential to avoid unnecessary charges. As a courtesy, the Photographer may provide a reminder or confirmation message the day prior to the scheduled session; however, this is not guaranteed and should not be relied upon as a formal confirmation or rescheduling prompt. The absence of this reminder does not entitle the Client to a refund or exemption from fees if the Photographer has already traveled to the location.

4. Refuse or Terminate Services: 

The Service Provider reserves the right to refuse or terminate services at any time if the Service Provider believes or feels a client (or individuals associated with the client) exhibits, but not limited to, unruly, disrespectful, or inappropriate behavior. Professional conduct is expected from all parties, and any actions that create an unsafe, disruptive, or hostile environment may result in the immediate cancellation of services without a refund. In short, treat the Service Provider(s) the same way you want to be treated with dignity and respect. 

5. Image Delivery and Turnaround Time: 

Edited images will be delivered through an online gallery provided by Danny Ivan Media/dannyivanmedia.com or other means requested. Our business is committed to providing a 24-hour turnaround time to ensure fast and efficient service for our customers. However, unforeseen circumstances may occasionally cause slight delays. We always strive to communicate promptly and work diligently to resolve any issues to meet our customers' expectations.

6. Cloud Storage Policy: 

Clients receive 30 days of complimentary cloud storage for their photographs as part of their service. At the end of the 30-days, the storage will expire at the end of the 30-day period, and photos will be removed from the cloud.

7. Copyright and Usage Rights: 

All images remain the intellectual property of Danny Ivan Media. The Client receives a license for personal or commercial use relating to the photo session selected. Images may not be altered, resold, or used for purposes outside the agreed license without permission.

8. Model Release: 

By engaging the Service Provider's services, the Client grants permission for the Service Provider to use images for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.

9. Liability and Indemnification: 

The Service Provider is not liable for circumstances beyond control, such as weather conditions, venue restrictions, or unforeseen technical issues. The Client agrees to indemnify the Service Provider against any claims arising from the use of the images.

10. Client Responsibilities: 

The Client is responsible for ensuring the property is safe, prepared and staged for the photography session; the Service Provider is not liable for any damage to, or issues arising from, items left on the premises that are not essential to the photo session or that pose a risk of unnecessary damage. The Client is responsible for securing permissions for locations and subjects to be photographed. If necessary permissions are not obtained, the Service Provider is not responsible for any resulting issues. The location of the photography session must be made available, without interruption, to the Service provider to perform services upon arrival; failure to have the location of the photography available during the scheduled timeframe may result in a cancelled or incomplete session and a refund will not be issued. 

11. Editing and Retouching: 

The Service Provider provides professional editing and retouching as part of the service. Requests for additional edits beyond the initial adjustments may incur an extra fee.

12. Floor Plans:  

Floor Plans provided are for marketing and illustrative purposes only and are not intended for use in appraisals, valuations, or legal documentation. All measurements are approximate and subject to error, omissions, and variations. Buyers and agents are encouraged to verify all dimensions and details independently before making any purchasing decisions.

13. In the event that the scope of the original service changes due to inaccurate or incomplete information provided by the Client—such as incorrect property square footage, additional services requested, or other unforeseen requirements—the Service Provider reserves the right to issue a second invoice (Also known as "rebill") for the additional work performed. The Client agrees to pay any such additional charges prior to delivery of the final media. All rebilled services will be calculated at the Service Provider’s standard rates at the time of service.

14. Confidentiality: 

All client information is kept confidential and will not be shared with third parties without consent, except as required by law.

15. Governing Law: 

These terms and conditions shall be governed by the laws of Arizona and associated areas (town, cities, etc.) and any disputes will be resolved in the applicable courts.

16. Agreement: 

By booking a session, the Client acknowledges that they have read, understood, and agreed to these terms and conditions. 


Aerial Services - Drone


1. Services Provided We offer aerial drone services including, but not limited to: 

Photography and videography, Event coverage, Patrol, and Photography for Inspections. Services are subject to availability, weather conditions, and legal flight restrictions. Any additional services requested may be subject to additional fees. The Service Provider is subject to provide photo images based on market standards without given direction and subject to the Service Provider's discretion. Feel free to communicate with the Service Provider on additional details based on your needs or of your clients.

2. Client Responsibilities: 

Obtain all necessary permissions and approvals for us to operate drones over private property or events. Ensure safe and legal access to the property or area where the drone operation will occur. Provide accurate details regarding location, timing, and scope of work.

3. Flight Restrictions Drone flights are subject to: 

FAA/CAA or local aviation authority regulations, weather conditions, No-fly zones (e.g., near airports, military bases, etc.), altitude and line-of-sight limitations. We reserve the right to cancel or reschedule flights due to any of the above restrictions.

4. Safety and Liability: 

Safety is our top priority. The Client acknowledges drone operations can be hazardous in certain environments. We maintain appropriate insurance for drone operations. We are not liable for delays, cancellations, or loss of footage due to uncontrollable conditions, including weather or technical issues. The Service Provider is not responsible for any personal injury, property damage, or other incidents that occur during the session. In the unlikely event of data loss or equipment failure, the Service Provider's liability is limited to a full refund of the session fee.

9. Cloud Storage Policy: 

Clients receive 30 days of complimentary cloud storage for their photographs as part of their service. If a new service is purchased within this 30-day period, the storage will be renewed for an additional 30 days from the latest service date. If no new service is purchased, the storage will expire at the end of the 30-day period, and photos will be removed from the cloud.

10. Ownership and Usage Rights: 

Danny Ivan Media retains the copyright to all images and footage unless otherwise agreed in writing. The Client is granted a non-exclusive license to use the media for its intended purpose. Media may not be resold or redistributed for monetary gain without written permission.

11. Editing and Retouching: 

The Service Provider does not provide professional editing and retouching as part of the service. Requests for additional edits may incur an extra fee.

12. Confidentiality: 

We will not disclose any confidential information obtained during the performance of services without your consent, unless required by law.

13. Force Majeure: 

We are not liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, weather, government restrictions, or technical failures.

14. Governing Law: 

These Terms and Conditions shall be governed by and construed in accordance with the laws of Arizona, USA, and any disputes will be subject to the exclusive jurisdiction of the courts therein.

15. Agreement: 

By booking a session, the Client acknowledges that they have read, understood, and agreed to these terms and conditions. 


For Portrait Purposes:


1. Booking and Payment: 

A 25% non-refundable deposit is required to secure your booking. The remaining balance must be paid two (2) days before the scheduled session date. Payment can be made via accepted payment methods by the Danny Ivan Media. Sessions are scheduled on a first-come, first-served basis. A session is only confirmed upon receipt of the deposit.

2. Cancellation and Rescheduling: 

Cancellations must be made at least 24-hours in advance to be eligible for rescheduling without loss to your non-refundable deposit. Failure to cancel before 24-hour notice will result in complete loss of your non-refundable deposit and a new non-refundable deposit will be required for future bookings. In the event of unforeseen circumstances (e.g., illness, weather conditions), the session may be rescheduled at a mutually agreed-upon date. The Service Provider reserves the right to cancel or reschedule a session due to emergencies or circumstances beyond their control. In such cases, the deposit may be refunded.

3. Session Details: 

The client is responsible for arriving on time. Any delay may result in a shorter session duration. Outfits, props, and location choices should be discussed in advance to ensure a smooth session. Additional time or location changes may incur extra fees.

4. Refuse or Terminate Services: 

The Service Provider reserves the right to refuse or terminate services at any time if the Service Provider believes or feels a client (or individuals associated with the client) exhibits, but not limited to, unruly, disrespectful, or inappropriate behavior. Professional conduct is expected from all parties, and any actions that create an unsafe, disruptive, or hostile environment may result in the immediate cancellation of services without a refund. In short, treat the Service Provider(s) the same way you want to be treated with dignity and respect. 

5. Image Delivery and Usage: 

Edited digital images will be delivered up to a four-week timeframe via through dannyivanmedia.com. Raw or unedited images will not be provided. The client receives a limited, non-commercial license for personal use of the images. The Service Provider retains full copyright and may use the images for portfolio, marketing, and promotional purposes unless the client requests in writing to keep them private. If client wishes to use their photographs for commercial use, please draft a licensing agreement to negotiate with the Service Provider. 

6. Retouching and Editing: 

Basic retouching (color correction, blemish removal, etc.) is included in the service. Additional retouching requests or laborious editing may be subject to additional fees.

7. Liability: 

The Service Provider is not responsible for any personal injury, property damage, or other incidents that occur during the session. In the unlikely event of data loss or equipment failure, the Service Provider's liability is limited to a full refund of the session fee.

By booking a session, the client grants the Service Provider permission to use images for portfolio and marketing purposes unless otherwise agreed in writing.

9. Agreement: 

By booking a portrait session, the client agrees to these terms and conditions. For any questions or concerns, please contact your Service Provider.
